Terms of Use of the Application

CaRool is a service company specializing in the analysis of vehicle and heavy-duty tires and tire management as part of fleet monitoring. These general terms of use (hereinafter referred to as "Terms of Use") apply without restriction or reservation to any user (hereinafter referred to as the "User") browsing the website xxx.ca-rool.com (xxx being the subdomain corresponding to the name of the company offering the service) or using the mobile application distributed by CaRool (together the "Applications").

 

CaRool is a corporation with a share capital of 1250.00 euros, with its registered office located at 22 rue des Monts Clairs 92700 Colombes, France, registered with the Nanterre Trade and Companies Registry under number B 908 137 441 (hereinafter referred to as "CaRool").

Acceptance and modifications

Any use of the CaRool Applications implies prior knowledge and unconditional acceptance of these Terms of Use by the User.

The Terms of Use are intended to govern the conditions of use of the CaRool Applications.

CaRool reserves the right to modify its Terms of Use at any time, particularly to evolve its Applications or comply with any new applicable regulations. The applicable Terms of Use will be those in force at the date of use of the Applications.

The User will have access to the Terms of Use at any time on all the Applications, and it is therefore advisable to consult them regularly to stay informed of updates.

The User will be notified if the Terms of Use have been modified since their last use, and will need to consult and validate the new Terms of Use in order to access the Applications.

1. Terms of Use of the Applications

By accessing the Site, the User agrees to comply with its terms of use and declares that they have prior access to the Internet, knowledge of its rules and practices, technical capabilities and performances, and have all necessary hardware and software for browsing the Internet.

The User guarantees CaRool against any unlawful, non-compliant, and/or unauthorized use of the information accessible via this application.

The User is solely responsible for the use of the information accessible via the application that CaRool reserves the right to modify at any time, notably by updating this site. CaRool reserves the right to delete or modify certain features of the site, without notice or compensation.

The User agrees to respect Internet practices and regulations and not to disclose illegal information via the Site.

The user is solely responsible for the identity they disclose and the information they provide.

Any use of any data made from the User's email address is deemed to have been made by them. CaRool does not guarantee the accuracy or completeness of the information offered by the referenced sites.

Limit of use

It is prohibited to copy, sell, exploit, publish, distribute, reproduce, represent, or adapt, for public or private use, and regardless of the intended purpose, the content of the Site.

2. Responsibility of CaRool

CaRool makes every reasonable effort to provide quality service to the User. However, the User acknowledges that CaRool is only bound by an obligation of means.

  • The information provided to the User is for informational purposes only and has no contractual value.

  • The User acknowledges that the proper functioning of the Applications is subject to conditions of access to the Internet network and its possible limitations and restrictions (coverage, saturation, availability). Therefore, CaRool cannot be held responsible on this basis.

CaRool cannot be held responsible for:

  • any damage resulting from the temporary inability to access its Applications,

  • any consequences resulting from a malfunction or restricted or degraded access to the Internet by the User,

  • any event resulting from a force majeure event that would delay or prevent the performance of its obligations.

The Applications will be accessible 24 hours a day, 7 days a week. However, they may be temporarily unavailable during maintenance operations necessary for their proper functioning and in the event of an event beyond our control. Maintenance operations take place at the discretion of CaRool, without notice. In the event of a technical failure affecting the operation of the application, we undertake to make our best efforts to restore the operation of the application as soon as possible.

We cannot be held responsible for external intrusions, the presence of computer viruses in the Users' system, the possible consequences of total or partial alteration, and the operation of the Applications.

No information or data, whether oral or written, obtained by Users by consulting the application or accessing its features, is likely to create warranties other than those expressly provided for in the Terms of Use.

Users are solely responsible for the use they make of this information and data. We cannot be held responsible for direct or indirect damages resulting from the use of this information and data by Users. In no event shall our liability be incurred for indirect damages, including any commercial, moral, or financial loss, including any loss of profits related to the use of the Applications.

This service is offered to users. It is established by CaRool, an expert in tire diagnostics, solely based on the visuals provided by the user. CaRool's liability cannot be engaged for any defects that are not apparent or visually detectable. In case of doubt or for a complete diagnosis, the user is invited to consult a professional.


CaRool is responsible and solely responsible for its analysis service.

User Responsibility

The User is responsible for the risks associated with the use of their login ID and password associated with the CaRool account. The User's password must remain confidential. The User agrees to protect and ensure the confidentiality of their authentication credentials, noting that they remain fully responsible for all activities that occur on the Applications and on their CaRool account, whether or not they are aware of them.


Users undertake not to use the Applications with content and statements that are obscene, racist, religious, discriminatory, inciting hatred, as well as content and statements contrary to regulations, infringing on the rights of third parties and personality rights, including content and statements:

 

  • Reproducing without authorization a work protected by intellectual property rights (such as trademarks, designs, and copyrights),

  • Infringing on the right to image and/or the right to respect for private life,

  • Infringing on the protection of personal data of a third party,

  • Redirecting to one of the sites https://xxx.ca-rool.com/ from sites containing the statements or contents mentioned above is also prohibited.

Any violation of the Terms of Use may result in criminal and/or civil proceedings against the User and the deletion of their account.

3. Personal Information

In accordance with the regulations regarding the protection of personal data, CaRool informs you that it respects the confidentiality, integrity, and security of the data that you may communicate to it through its application. 

Any personally identifiable information - including name, first name, postal and email addresses, telephone numbers - or indirectly identifiable information - such as computer traces left by your browsing on this site - are considered confidential data and are treated as such. 

The User is informed that the personal information requested is necessary for the processing of their request. This information is intended exclusively for CaRool. 

In accordance with the applicable regulations regarding the protection of personal data, you have the right to access, rectify, object to, limit processing, request data portability where possible, and erase your data. CaRool expressly invites the User to familiarize themselves with its Privacy Policy, which is an integral part of the Terms of Use.

 

The User undertakes to provide only accurate information that does not harm the interests of third parties. Personal information and contact details of visitors will only be disclosed to third parties if the User has expressly given their authorization at the time of entering the information.

 

In case of difficulty in managing your personal data, you can file a complaint with the CNIL (Commission Nationale de l'Informatique et des Libertés).

4. Intellectual Property

The User acknowledges that all content appearing on the Applications, including but not limited to: the domain name, trademarks, texts, graphics, photographs, drawings, sounds, data, images, audios, and videos, as well as the structure of CaRool, its navigation plan, its logos, the design and organization of its sections, their titles, databases, their structures and their contents, existing or future, are protected and are the exclusive property of CaRool.

Therefore, without the express prior authorization of CaRool, all reproductions, representations, and uses by the User are prohibited.

In this regard, the User undertakes, without limitation, not to download, extract, store, use, reproduce, sell, communicate, represent, distribute, adapt, or borrow content from services protected by intellectual property rights, directly or indirectly, on any medium, by any means, and in any form whatsoever, without the express authorization of CaRool.

No license or other right to use any intellectual property right is granted to the User. Violation of these provisions subjects the responsible User to criminal and civil penalties provided for by applicable law.

5. Applicable Law and Dispute Resolution

The Terms of Use are subject to French law.

In the event of any difficulty regarding the validity, application, or interpretation of the Terms of Use, the User is invited to contact CaRool by email at contact@ca-rool.com.

In the absence of an amicable settlement, any dispute shall be submitted to the French courts.
